Open Alcohol Bottles

Anyone knows what the law on open containers as it relates to a SMB. Can you carry open bottled given that it's technically an RV?

Re: Open Alcohol Bottles

I think it differs from state to state. In CA, apparently you are "allowed" to have an open container behind the drivers seat in a class B. I think a lot of people avoid having open containers so they don't chance it.

Re: Open Alcohol Bottles

In Oregon you can have one in an RV, just not up front. Here is the exemption from the open container law:

This paragraph does not apply to the living quarters of a camper or motor home.
One of my state police friends suggested placing a blanket between the cab and "house" to make the situation less conspicuous.

Re: Open Alcohol Bottles

For this to apply, you'd technically need to have 'RV' plates, right?

Re: Open Alcohol Bottles

Logic would lend one to think that an open alcoholic container near a driver of any vehicle in motion would be against the law, regardless of the type of vehicle. I don't think the judge would be too concerned about a "technicality" in this situation.

Re: Open Alcohol Bottles

They never see the open alcohol in my van. One look at the small kids I have tied up usually distracts the authorities. "free candy"

I keep any opened bottles in the rear side storage and usually have some towels stuffed around them so they don't move. I don't know what the technicalities are but in order for me to access it while driving I would have to set the cruise control....

If you haven't heard the great John Prine, here is one of his wonderful folk songs, "They Ought to Name a Drink After You":

No, I don't believe that is the case. Being a camper is defined by its amenities (permanent sleeping, cooing, and toilet facilities), which allows for RV registration. The statute does not refer having RV registration, so I would defer to the RV/camper definition. I'm not a lawyer however, so my advice it only worth that you paid for it
