Better keep your Forest Service photos non-commercial....

When the "people" own everything.
No one owns anything.

"United Socialist States of America. How do you like that name?" -- Hank Williams, Jr.

Well they might as well start prosecuting and confiscating from the estate of Ansel Adams, because it looks like he and his posterity are nothing but thieves stealing from the "people."

I mean he didn't actually "produce" those photos of Yosemite, did he?
His artistry and talent contributed nothing in comparison to the "people's" right to his stolen art.

The Fountainhead -- Any Rand.

Now I will say that if there's some major commercial effort, especially if it prevents other visitors from enjoying the forest, then yes I think there should be a permit.

I have seen the 'leftovers' from commercial film/photos shoots where things were left behind in the wilderness, so I can the see some cause for concern, but this seems like a very draconian implementation.

Great, thankfully I don't sell pictures but I've sure posted a bunch. I hope they find this law Unconstitutional. What the hell is wrong with this group running the forest service.

Re: Fees/fines for commercial photography in US Forests

This story has been around the web for the last couple of days on photography forums, drone/quadcopter forums, and that bastion of complete and total factual information called Facebook. And there's been a lot of misplaced outrage.

Problem is, most of the linked stories are critically incomplete, which makes them inaccurate. The important two items the links commonly leave out are:

1. It applies only to commercial photography, and,
2. Only to Congressionally designated wilderness areas that are under the purvue of the US Forest Service.

Even the Washington Post was short on the facts, or they deliberately left them out. With the drastic drop in reporting quality (fact checking is a lost art over there) and the increase of Copy & Paste Journalism at the Post over the past few years, who's to say?

The rule doesn't apply to the general public. Unless you are a commercial operation doing filming in said designated wilderness areas, you can still take pictures of most USFS stuff all you want. No permit required, no fines incurred.

The rule is 4 years old. The USFS is just cracking down now. This isn't really news, other than it just got traction on the web this week.

Here's the article that I believe started the whole hoo-rah, and then was passed along minus the important bits:

...and another later article:

I have been wondering about this since it started going around, but didn't know enough (or take the time) to figure out whether it was accurate or not. Thanks for providing your knowledgeable perspective.

Re: Fees/fines for commercial photography in US Forests

Nothing in the discussion so far has implied anything other than applying to commercial work, but how you define commercial could get sticky. So Daveb takes some pictures in one of the subject areas and posts it to his blog. Well maybe his blog is sponsored, or he generates some revenue by having some ads on it. Is his the photo now used for commercial purposes, and is Daveb not subject to a $1000 fine?

Also, the disclaimer of "Only to Congressionally designated wilderness areas that are under the purvue of the US Forest Service" doesn't make me feel better one little bit. Why are those areas subject to this permit/fee/fine? How do we see major shifts in public policy? Start small and then expand it, like the Forest Service Recreation Fee.

The BLM is already enforcing fees for some Photogs at various events. They have even used the same concept to harass private citizens (friends) when they wanted to - kind of a "your tail light was out" approach.

Government run amuck! Our founding fathers would rebel again...
