Hmm..if one owns a VW with referenced engine and one receives such a recall notice could one in theory disregard the recall notice and choose to continue operate their vehicle at the higher rate of power, torque, and efficiency?

Since they put a probe in the tailpipe I guess it's the same way you "know" when you get a colonoscopy.
Seriously though I would guess that it's not related to the emissions test itself but that it defaults to the 'clean' engine management parameters when run within a certain RPM range. Isn't the testing done at idle these days? And BTW, according to Reuters, VW USA confirmed the story yesterday.

I don't know, but I wonder if they connect the OBD2 port to the testing equipment and let the computers talk. Not living in CA, I am just guessing.

You got me curious about it so I went to the NY Times article and this is what I read:
"The Environmental Protection Agency accused the German automaker of using software to detect when the car is undergoing its periodic state emissions testing. Only during such tests are the cars’ full emissions control systems turned on. During normal driving situations, the controls are turned off, allowing the cars to spew as much as 40 times as much pollution as allowed under the Clean Air Act, the E.P.A. said."
And: (the Chief Executive), Mr. Winterkorn did not contest assertions by the E.P.A. that Volkswagen sold cars equipped with software that could detect when periodic state government emissions testing was taking place.
So yeah, sophisticated enough to communicate with the testing computer and turn the emissions controls on just for the test. How did they think they'd get away with that?
